After a long time we are again here. There are many reasons for this long gap. May be due to the fact that our case not came to hearing, it just gets posted .  Anyway thanks to our lawyer, finally our case came for final hearing on yesterday and today and the judgement  reserved. These two days especially on today judges almost spent three and half hours on arguments i n our case.

Yesterday when our case came to hearing our lawyer very briefly explained. The BSNL lawyer brought the Karnataka Second case and also mentioned Ernakulam two cases. Though our lawyer clarified only one case, he again told two. At this moment Judge asked BSNL lawyer how much time he wants to argue, he replied 1 hour. Then judge asked our lawyer for posting tomorrow which is readily accepted by both parties as it is already time for LUNCH.
Our lawyer stayed back at Hyd though he is having many other cases at BG.
Today at about 11:30 final hearing of our started. First our Mr Kulkarni in his argument explained all the facts that led to filling of this case. Explaining the BG CAT Judgement with mentioning Mr Sadasivan Case with relavent causes. Each and point he explained what happened in CAT, High Court and then in Supreme court and then again in BG High Court saying that the case is attained its finality. Both the judges are got impressed and noted all the points that are raised by our lawyer. This is the rare situation that almost all the points both the judges noted down. Then Our lawyer explained about other cases that are there in various courts in all India and the BSNL stand on these issue including very recent judgement of Chandigarh CAT.(He explained BSNL stand on this issue and countered it) Also mentioned the cases in AP High Court. And finally Supreme Court present seniority case. In his concluding remarks he pressed to give re-leaf on lines of BG CAT with special reference that the when a junior in list given the benefits, senior must also get it other wise against constitution right to equality.

Then BSNL Lawyer stated his counter with reference to same cases saying that let us wait until the other cases gets disposed. He also mentioned that BG CAT itself in BG Second case is not yet passed order for past one year. Then our lawyer told it is there due to judge transfer case cAME FOR HEARING AGAIN NOTHING ELSE AND NOW THAT IS POSTED THIS 19TH. Then the BSNL lawyer started mentioning various rules starting from 1960,1980's , competitive and qualifying cases Allahabad case etc.( In our opinion at this point he completely our of track.) The complete argument revolves around that BG CAT judgement not attained finality and wait until SC decision. ie they didn't directly opposed our case. then our lawyer asked whether all the cases that are mentioned are relevant to present case.    Judges also asked whether they are having copies of those cases. which replied negative. Then the judges given one week time and judgement reserved.

I t seems that Judges are not very much keen on BSNL Lawyer argument which mainly based on other court cases.

Anyway friends we done our duty by filling case and engaging powerfull lawyer. He also put his efforts whole heatedly otherwise in this short 7 months time it may not come to final stage. Now we wait for the Judgement.
After pronouncement of Judgement we will meet Mr Kulkurni at BG for further course of action. The judgement is expected in 15-30 days time.

Let us hope that it will come in our favour, and pray god  for the same.

Yesterday on 25th March, I myself witness the proceedings in the court. For the first time arguments taken place in our case.


First BSNL lawyer didn't filed any reply and requested for more time. But our Lawyer strongly protested and pressed for arguments for which Judges accepted. First our lawyer briefed the case history and the bangalore High courts final order. He also pointed that the Karnataka Judgement attained finality. Also pointed the first batch judgement is also given by the same bench of this court. And hence requested to grant same releaf.

Then BSNL lawyer presented that the case before Supreme Court. He pointed the seniority case and this notional is interrelated and refered the judgement of MUMBAI, CHANDIGHAR ,Ernakulam and Jabalpur cases. He told the SLP's pending in the Supreme Court. He tried to impress this case can taken after those cases.

At this point our Lawyered clearly explained the judges that they are not requesting any seniority and they only wanted the monitory benifits. he quoted the BG JUDGEMENT. Also clarified that technicall terms like single line judgement and dismissed on merits in Supreme Court Judgement. At this moment again BSNL Lawyer confused himself and tried to confuse the Judeges.

Our lawyer now explained all the SLP's in Supreme Court, what is what. as he himself representing the case in those cases. And he requested to pass immediate releaf in this case. Also presented that BSNL approached High court and contempt is pending in CAT also. Also asked to grant releaf in this case and if BSNL want let they take this also to HIGH COURT and we are also ready.

At this point of time the two Judges almost discussed them self for about 5min. It appear that they may takeking decission now it self. But as BSNL not yet filed its reply they hesitated to give judgement and with acceptence of our lawyer they postponed for 22 of next month for reply.

Now friends as per our case concerned our lawyer very effectively presented our version by showing the reply given by BSNL to our individual representations. If every thing goes smooth by next hearing our case yeild some result.

But in mean while on April 8 th our previous batch case come in High Court. If there BSNL gets some type of stay on previous judgements, then our plans to be revised.

Dear Friends

To day our case came in front of court-2 for reply from respondents. Our lawyer also attended the court. Immediately after start of court BSNL lawyer requested for more time to file the reply at least by 30 to 45 days. For this our lawyer strongly objected saying that this is well proven case no need to give more time to file reply, and they just enough to give reply why they are not gving the increments. He also pointed out that the same court is issued order in other case in favour of applicants. Judge agreed with argument, but on the request of BSNL lawyer he want to give final chance to file reply. Our lawyer readily aggreed for this final chance and then Judge posted case to 25 of this month without giving much time to BSNL.  

In the mean while this month 18th hearing is in Supreme court on this same SLP filed by BSNL in Jabalpur Case and also in seniority case. Our lawyer is only going to argur the case. Expecting positive result from those cases.....

After a lengthy vacation we are again here. As " better late than never"  today our lawyer assistand came to hyd and submitted the required necessary papers to the CAT. The papers verification and making copies of the OA is also done. Now CAT will issue notices to the respondents on Thursday in the presence of our lawyer. And may be after one or one and half month the case will comes to hearing on regular basis. So until that time patiently we should wait.

Many of us are having doubts that why this much time taken for filling the case in the CAT as we are worrying about the time. Though the things and situation forced like that, finally we are at the feeling that the time is not wasted by looking at the  work done by our Lawyer in the back ground. 

Though none of member questioned us in respect of the delay, it is our responsibility to brief the things happened in last few days.

First and most important one is the health problems of our Lawyer family, due to which he is unable to concentrate on our case. After every thing is well, he started building up our case. He gone through each and every biodata and compared with BSNL LDCE result data and respective CGM's promotion orders. He compared each one of us with the Karnataka LDCE first court case batch to get the junior most member in that year and compared the seniority in this case. Another reason for delay is he wanted to include the Karnataka Second Judgement which expected to deliver at any time in last week of December. But unfortunately due to transfer of the CAT Member, the judgement is yet to deliver there by dropping the idea to include that judgement and separately now the case is filed. Also due to the order copies of respective CGM's not clear thereby causing time delay. Finally due to the delay in obtaining all HYD CAT & High Court proceedings  orders in our seniors previous cases. At this time we extent our sincear thanks to Mr Murthy, and Mr Krishna Murthy for their cooperation in obtaining all these orders. Similarly to Mr M.Prasad SDE Tandem HYD for taking much strain in scanning all the orders of 75% quota orders issued in 2000 and 2001 and made available to us as soft copies though he is no way concerns to our cases.

By seeing the way that our Lawyer building the case and representing the case, it again reiterated that we are not gone wrong in selecting  him as our Lawer.

Note: In between our first meeting with our lawyer and filling the case the following important events happened which may influence our case also.

1. BSNL appealed against the Jabalpur CAT order directly to Supreme Court threw a SLP which is admitted. The outcome will having direct impact on our case. This is also  taken up by our Lawyer.

2. BSNL also moved to AP High Court on the contempt filed by our seniors. This is yet to admit.

నిన్నటి రోజు మన సుధీర్గ ప్రయాణంలో ఒక చిన్న అడుగు పడింది. అది చిన్న అడుగే ఐనప్పటికీ బలమైన అడుగుగా భావించవచ్చు.  

I and Ramakanth Sharma yesterday met our lawyer in Bangalore and handed over all our vakalath and  Bio-data forms to him and there by completing the formalities from our side. He is very much appreciated our efforts and assured, he will also act as fast as we did the things.  With in a week or so he may file the case in HYD  CAT. 

It is the right time to appreciate sincere work of  our fellow members like Mr Murali Krishna Reddy the driving force, Mr R V Vijay Kumar for compiling the bio-data's and seniority no of our members, Mr Ananth the chief Accounts Officer of this case,Mr Sudhakar, Mr Ashok and Mr Nagavi.
